海外投资人权风险规避析论——由达尔富尔问题引发的思考Prevention and Control of Human Rights Risk in Overseas Investment Field

摘要(Abstract)：
海外投资人权风险是不同于海外投资法律风险和政治风险的新型风险,对海外投资人权风险的管控和规避本质上是对人的人权风险的管控和规避。国际性和区域性人权文件为工商企业承担尊重人权的责任提供了依据。尊重人权的责任要求工商企业应避免侵害他人的人权,并应在自身卷入时消除负面人权影响。负责任参与使在敏感人权环境中投资经营的企业既可利用难得的商业机会,又不至于侵犯人权。
